Referral Partner Program Terms

These terms ("Terms") govern participation in the MarinOak referral partner program (the "Program") operated by MarinOak ("we," "us," or "our"). By registering for the Program or submitting a referral, you ("you" or "Partner") agree to these Terms.

1. What the Program is

The Program lets you refer property owners to MarinOak's property management services. When a property owner you refer through your unique referral link signs a MarinOak property management agreement, you earn a reward based on the size of the referred property (see Section 5), and the referred owner receives their first month of management fee waived.

2. Eligibility

  • You must be at least 18 years old.
  • You register with accurate contact information and receive one unique referral link and code.
  • You may not refer yourself, a property you own or control, or an owner who is already a MarinOak client or already in discussions with MarinOak.
  • You must not have obtained the owner's information while soliciting on MarinOak's behalf.

3. Your role is limited to an introduction

Your role in the Program is strictly limited to making an introduction by sharing your referral link. You are not authorized to, and agree that you will not:

  • Solicit, negotiate, or discuss the terms of any management agreement on MarinOak's behalf;
  • Represent yourself as an agent, employee, or representative of MarinOak;
  • Make any representations, promises, or guarantees about MarinOak or its services;
  • Participate in the transaction beyond providing the introduction.

The Program does not create any employment, agency, partnership, or joint-venture relationship between you and MarinOak. You are an independent participant.

4. How you earn a reward

  • A reward is earned only when a property owner you referred signs a MarinOak property management agreement.
  • Submitting a referral, or an owner merely contacting us, does not earn a reward.
  • One reward is paid per newly signed owner. The owner must be new to MarinOak and attributable to your referral.
  • MarinOak determines, in its reasonable discretion, whether a referral qualifies (see Section 5 for the reward schedule).

5. Payment

  • The reward is determined by the size of the referred property at the time of signing:
    • Single-family home or condo — $1,000
    • 2–4 units — $1,500
    • 5–10 units — $2,500
    • 11+ units — $3,000
  • Rewards are issued within five business days of the owner signing the management agreement, by a method of our choosing (e.g., check, ACH, or Zelle).
  • You must provide a completed IRS Form W-9 before we can issue payment. Rewards are reportable income; we will issue a Form 1099 where required by law, and you are responsible for any taxes owed.

6. Owner incentive

The property owner you refer receives their first month of management fee waived after signing, applied to their account. This incentive is for the referred owner only and has no cash value to you.

7. Client return commitment

The following are Program commitments, not courtesies:

  • If a referred owner decides to sell a property we manage, we will refer the listing opportunity to the referring Partner.
  • We will not solicit the sale of any property owned by a referred owner.
  • We will notify the referring Partner promptly when a referred owner signals intent to sell.

These commitments apply for as long as the referred owner's property remains under MarinOak management and for six months after management ends.

8. Disqualification and withheld rewards

We may withhold or deny a reward, and may suspend or remove you from the Program, if we determine that a referral involves:

  • A self-referral, or a property you own or control;
  • An owner already a MarinOak client or already in our pipeline;
  • Duplicate, fraudulent, incomplete, or inaccurate submissions;
  • Any conduct exceeding a permitted introduction (see Section 3); or
  • Any violation of these Terms or applicable law.

If we determine after payment that a referral involved collusion or bad faith — for example, an owner who signed with no genuine intent to remain a client — the reward is repayable on demand and may be offset against any future rewards. This does not apply to owners who end management for ordinary reasons.

9. Consent and privacy

Before sharing anyone's contact information with us, you confirm you have obtained any consent required to do so. Information you submit is handled in accordance with our Privacy Policy.

10. Changes or ending the Program

We may change these Terms, or modify, suspend, or end the Program, at any time and for any reason. Material changes will be posted on this page. Your continued participation after changes are posted constitutes acceptance of the updated Terms. Referrals that have already resulted in a signed agreement before a change takes effect will be honored under the terms then in effect.

11. Owner disclosure

MarinOak may disclose to the referred owner that a referral reward was or will be paid in connection with their agreement.

12. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any dispute will be subject to the exclusive jurisdiction of the courts located in the San Francisco Bay Area, California.
